Shortlet.ng Terms and Conditions

Welcome to Shortlet.ng!

These Terms and Conditions ("Terms") govern your access to and use of the Shortlet.ng platform ("Platform") including the website, mobile application, and all associated services. By accessing or using the Platform, you agree to be bound by these Terms.

1. Definitions

• Account: means an account created by a User on the Platform.
• Host: means a User who lists an Accommodation for Booking on the Platform.
• Guest: means a User who Books an Accommodation through the Platform.
• Accommodation: means a property listed for short-term rental on the Platform.
• Booking: means a confirmed reservation for an Accommodation made by a Guest through the Platform.
• Content: includes all information, data, text, software, sound, photographs, graphics, videos, messages, or other materials uploaded or posted on the Platform.
• Shortlet.ng: means the platform operated by [Your Company Name].

2. User Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Platform.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to keep your account information accurate and updated.
• Shortlet.ng reserves the right to suspend or terminate your account if you violate these Terms.

4. Host Responsibilities

• Hosts are solely responsible for the accuracy, completeness, and legality of the information they provide about their Accommodations, including descriptions, photos, amenities, and house rules.
• Hosts must ensure their Accommodations are safe, clean, and habitable for Guests.
• Hosts must comply with all applicable laws and regulations regarding short-term rentals in their jurisdiction.
• Hosts are responsible for communicating clearly with Guests regarding booking confirmation, check-in/out procedures, house rules, and any additional fees.
• Hosts are responsible for collecting any applicable taxes or fees from Guests.

5. Guest Responsibilities

• Guests are responsible for complying with all house rules set by the Host.
• Guests are responsible for respecting the property and its contents.
• Guests are responsible for their own conduct and the conduct of their guests during their stay.
• Guests are responsible for paying the Booking amount in full, including any applicable fees and taxes.
• Guests must communicate clearly with the Host regarding any questions or concerns they may have.

6. Booking Process

• Bookings are confirmed once a Guest receives a confirmation email from Shortlet.ng.
• Guests are responsible for reviewing and agreeing to the house rules before confirming a Booking.
• Shortlet.ng is not responsible for any discrepancies between the Accommodation listing and the actual property.

7. Payment Processing

• Shortlet.ng processes payment transactions on behalf of Hosts and Guests.
• Shortlet.ng may charge a service fee for Bookings, which will be deducted from the payment received from the Guest.
• Any refunds due to cancellations or disputes will be processed in accordance with the cancellation policy (Section 8).

8. Cancellation Policy

• Cancellation policies are set by the Host and will be displayed on the Accommodation listing.
• Guests are responsible for reviewing the cancellation policy before confirming a Booking.
• Shortlet.ng is not responsible for any cancellation fees.

9. User Content

• You retain all ownership rights to the Content you upload or post on the Platform.
• By uploading or posting Content, you grant Shortlet.ng a non-exclusive, royalty-free license to use, reproduce, modify, publish, and distribute your Content in connection with the Platform.

10. Disclaimers and Warranties

• Shortlet.ng does not warrant the accuracy, completeness, or safety of any Content posted on the Platform.
• Shortlet.ng is not responsible for any interactions between Users.
• You use the Platform at your own risk. Shortlet.ng disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

• Shortlet.ng will not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or related to your use of the Platform, including damages for loss of profits, goodwill, use, data, or other intangible losses.
• Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Shortlet.ng, its officers, directors, employees, agents, and affiliates from and against any and all claims, losses, damages, liabilities, costs, and expenses (including attorney's fees) arising out of or relating to your use of the Platform, your violation of these Terms, or your violation of any rights of another User.

13. Dispute Resolution

Any dispute arising out of or relating to these Terms will be governed by and construed in accordance with the laws of Nigeria. You agree to the exclusive jurisdiction of the courts located in Nigeria for the resolution of any disputes arising out of or relating to these Terms.

14. Termination

• Shortlet.ng may terminate your access to the Platform at any time, with or without cause.
• You may terminate your Account at any time.

15. Entire Agreement

These Terms constitute the entire agreement between you and Shortlet.ng regarding your use of the Platform.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall remain in full force and effect.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Nigeria without regard to its conflict of law provisions. You agree to the exclusive jurisdiction of the courts located in Nigeria for the resolution of any disputes arising out of or relating to these Terms.

18. Amendment

Shortlet.ng reserves the right to amend these Terms at any time by posting the amended Terms on the Platform. You are responsible for reviewing the Terms periodically for any changes. Your continued use of the Platform after the amended Terms are posted constitutes your acceptance of the amended Terms.

19. Force Majeure

Shortlet.ng will not be held liable for any delay or failure to perform its obligations under these Terms due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, strikes, or natural disasters.

21. Insurance

Hosts are strongly encouraged to obtain appropriate insurance coverage for their Accommodations. Shortlet.ng is not responsible for any damage or loss to a Host's property or a Guest's belongings.

22. Intellectual Property

The Shortlet.ng logo, trademarks, service marks, and other intellectual property displayed on the Platform are the property of Shortlet.ng or its licensors. You are not permitted to use any of this intellectual property without the express written consent of Shortlet.ng.

23. Third-Party Links

The Platform may contain links to third-party websites or services. Shortlet.ng is not responsible for the content or privacy practices of any third-party websites or services. You access and use third-party websites or services at your own risk.

24. Governing Law for Guests and Hosts Outside Nigeria

If you are a Guest or Host located outside of Nigeria, you agree that these Terms will be governed by and construed in accordance with the laws of Nigeria without regard to its conflict of law provisions.

25. Data Privacy

Shortlet.ng collects and uses your personal data in accordance with its Privacy Policy, which is available on the Platform. You agree to the terms of the Privacy Policy by using the Platform.

26. Direct communication with the host

When directly communication with the host. Please take note of the following:

• Shortlet.ng strongly advises that you communicate with the host solely to confirm the suitability and availability of the property.
• All payments should be processed through the "Book Now" feature on Shortlet.ng's reservation page to ensure proper monitoring by Shortlet.ng.
• If you choose to make payment directly to the host, please be aware that Shortlet.ng DOES NOT have visibility and does not monitor such transactions.
Safety Recommendations:
• Never send any pre-payments to the host.
• Conduct an inspection of the property to ensure it meets your requirements.
• Only proceed with payment if you are fully satisfied with the property.

27. Miscellaneous

• These Terms, together with the Privacy Policy, constitute the entire agreement between you and Shortlet.ng regarding your use of the Platform.
• If any provision of these Terms is held to be invalid or unenforceable, such provision will be struck and the remaining provisions will remain in effect.
• Shortlet.ng's failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
• These Terms will be binding upon and inure to the benefit of the parties hereto and their respective successors and permitted assigns.
